In practice, proving overtime work can be difficult for employees\u2014especially in the absence of written evidence. In such cases,&nbsp;<strong>witness testimony<\/strong>becomes a primary means of proof. However, the&nbsp;<strong>Turkish Court of Cassation (Yarg\u0131tay)<\/strong>&nbsp;applies specific criteria in evaluating the reliability and sufficiency of witness statements, emphasizing that not every testimony can serve as conclusive evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. How Can an Employee Prove Overtime Work?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Turkish labor law, the&nbsp;<strong>burden of proof<\/strong>&nbsp;lies with the employee claiming unpaid overtime. The following means of evidence may be submitted:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Company records (e.g., attendance logs)<\/li>\n\n\n\n<li>Time cards or access control system data<\/li>\n\n\n\n<li>Payroll slips and wage statements<\/li>\n\n\n\n<li>Internal company correspondence (e.g., shift assignments)<\/li>\n\n\n\n<li>Employment contracts<\/li>\n\n\n\n<li>Bank transaction records<\/li>\n\n\n\n<li><strong>Witness statements<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, since such documents are often either not maintained or not accessible to the employee,&nbsp;<strong>witness testimony<\/strong>becomes the principal method for substantiating overtime claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. The Court of Cassation\u2019s Criteria for Witness Credibility<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its case law, the Court of Cassation insists that a witness&#8217;s statement must be&nbsp;<strong>firsthand<\/strong>,&nbsp;<strong>objective<\/strong>, and&nbsp;<strong>free from bias or shared interest<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its decision dated&nbsp;<strong>09.05.2023<\/strong>&nbsp;(9th Civil Chamber, Case No: 2023\/2223, Decision No: 2023\/6798), the Court held:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTestimony from witnesses who are unfamiliar with the working conditions of the workplace or who could not have had knowledge of the work schedule shall not be deemed reliable.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, the credibility of a witness is strengthened if they:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Worked\u00a0<strong>in the same department<\/strong>\u00a0as the claimant,<\/li>\n\n\n\n<li>Were present\u00a0<strong>during the alleged overtime hours<\/strong>,<\/li>\n\n\n\n<li>Had\u00a0<strong>direct observation<\/strong>\u00a0of the work being done.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Conflict of Interest and Reciprocal Witnessing<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of Cassation also warns against&nbsp;<strong>reciprocal or biased witness testimony<\/strong>. If a witness is also involved in a legal dispute against the same employer or is testifying in exchange for reciprocal support in their own case, their impartiality is questionable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a decision dated&nbsp;<strong>24.05.2016<\/strong>&nbsp;(7th Civil Chamber, E. 2015\/20952, K. 2016\/11178), the Court stated:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt has been established that the plaintiff\u2019s witnesses had filed similar lawsuits against the employer and had testified for each other in their respective cases. Therefore, reliance on such testimony was erroneous.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moreover, if a witness fails to disclose that the plaintiff had also testified in their own case, this may render their statement completely unreliable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. Is Witness Testimony Alone Sufficient Without Written Evidence?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its&nbsp;<strong>15.05.2023<\/strong>&nbsp;decision (9th Civil Chamber, E. 2023\/4113, K. 2023\/7144), the Court ruled that witness testimony alone is&nbsp;<strong>not sufficient<\/strong>&nbsp;when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The witness only observed part of the employee\u2019s work period,<\/li>\n\n\n\n<li>There is\u00a0<strong>no supporting documentary evidence<\/strong>,<\/li>\n\n\n\n<li>There is a clear\u00a0<strong>shared interest<\/strong>\u00a0between the witness and the plaintiff.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These rulings demonstrate that&nbsp;<strong>testimony must be corroborated by additional written evidence<\/strong>&nbsp;to be legally persuasive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. While&nbsp;<strong>witness statements<\/strong>&nbsp;alone may not suffice, when provided by credible individuals and reinforced with documentary evidence, they can play a key role in proving the claim.
