If your divorce is final abroad but you still appear “married” in Türkiye, you must complete recognition, and where needed enforcement, or—if eligible—the administrative registration route at the civil registry.
1) Recognition vs. Enforcement vs. Administrative Path
- Recognition: Makes the status (the divorce itself) legally valid in Türkiye.
- Enforcement (exequatur): Activates enforceable parts (alimony, damages, certain custody orders) for execution in Türkiye.
- Administrative registration: Since 2018, many finalized foreign divorces can be registered directly at the Population Directorate (Nüfus Müdürlüğü)—no court case—if formal and consent conditions are met.
In practice: recognized/registered = your marital status is updated; enforced = money/obligation parts can be executed.
2) Legal Bases (brief)
- Turkish PIL Code (Law 5718) Arts. 50–59: Recognition/enforcement.
- Family Courts are competent.
- Population Services framework (2018 update): permits administrative registration in qualifying cases.
3) Core Conditions (Recognition/Enforcement)
- Final and binding foreign judgment,
- No violation of public policy,
- Proper service of process and right to be heard,
- No conflicting final Turkish judgment on the same matter.
4) When Can You Use the Administrative Route?
Typically possible if:
- Judgment + apostille/legalization + sworn Turkish translation,
- Joint application by both spouses or one spouse applies with the other’s apostilled consent/power of attorney,
- You only seek status registration (not executing alimony etc.),
- Decision is final.
If any element is missing, proceed with a Family Court recognition/enforcement case.
5) Documents You’ll Need
- Full text of the foreign decree (with apostille or consular legalization) + sworn translation,
- Certificate of finality,
- Family registry extract (Nüfus Kayıt Örneği),
- Passports/IDs,
- For the administrative path: joint filing or apostilled consent/PoA of the ex-spouse and a serviceable address.
6) Timelines
- Administrative registration: same day to a few weeks if complete.
- Recognition in court: commonly 1–4 months (foreign service may extend this).
- Enforcement: may take longer depending on objections and evidence.
7) Common Pitfalls
- Attempting to enforce money/custody orders via the administrative channel (not possible).
- Missing apostille/finality or incomplete translations.
- Insisting on administrative filing when conditions are not met (time lost).
8) Why It Matters
Without recognition/registration you remain married in Turkish records, cannot remarry in Türkiye, and may face inheritance/property complications or child-record inconsistencies.

Ex-spouse won’t attend. → With a valid address, recognition may proceed; default judgment is possible if due process is met.
Mutual divorce abroad—new case in Türkiye? → No. Recognition/registration suffices.
